Terms of Service
1. Who we are
Mobile API Connect is operated by One91 Network Pte. Ltd., a private limited company incorporated in Singapore (UEN 201005367C). In this document, "we", "us" and "our" refer to that entity. "You" refers to the company or individual using the service.
2. What the service is
Mobile API Connect provides a REST API and an Android application that together allow your business to send and receive SMS messages through a SIM card owned and operated by you. The Android app is installed on your phone; we host the backend API; you connect them with an API key issued to you on first pair.
3. Eligibility
You must be at least 18 years old and authorised to enter into contracts on behalf of the business that uses the service. The service is intended for legitimate business use.
4. Acceptable use
You agree NOT to use Mobile API Connect to:
- Send unsolicited commercial SMS (spam) in violation of any applicable anti-spam law (CAN-SPAM, TCPA, GDPR / ePrivacy, India TRAI, Singapore Spam Control Act, etc.).
- Send SMS that impersonate another person, brand, or government entity.
- Send SMS containing fraudulent, deceptive, defamatory, harassing, threatening, obscene, or otherwise unlawful content.
- Send SMS to recipients who have opted out or revoked consent.
- Use the service for any premium-rate SMS scheme, lottery, betting, or financial activity that is illegal in the recipient's jurisdiction.
- Circumvent carrier policies, telecommunications regulations (including TRAI / IMDA / Ofcom / FCC rules), or any term of your SIM contract.
- Reverse-engineer, decompile, or attempt to extract source code from the app or backend.
- Resell access to the service without a written reseller agreement.
- Use the service to support any activity that violates the laws of Singapore, your jurisdiction, or the recipient's jurisdiction.
We reserve the right to suspend or terminate access immediately if we have reason to believe you are violating these rules.
5. Your responsibilities
- You are responsible for the SIM card, the Android phone, the SMS content you send, and the consent / opt-in basis on which you send to each recipient.
- You are responsible for paying your mobile carrier for any SMS sent through your SIM. We do not pay your carrier.
- You are responsible for keeping your API key and signing secret confidential. Treat them like passwords.
- You are responsible for the security of the webhook endpoint you configure and for verifying the HMAC signature on every inbound request.
6. Pricing
Pricing is published on the website. We may change pricing on 30 days written notice. Charges, where applicable, are billed in the currency stated on your invoice. You are responsible for any taxes applicable in your jurisdiction.
7. Service availability
We aim for high availability but do not guarantee uninterrupted service. We are not liable for outages caused by: your SIM, your Android device, your network, your carrier, your webhook endpoint, force majeure events, or scheduled maintenance announced in advance.
8. Intellectual property
The Mobile API Connect app, backend, branding, documentation, and APIs are owned by One91 Network Pte. Ltd. You are granted a non-exclusive, non-transferable, revocable licence to install and use the app on your business devices for the duration of your subscription. SMS content that you send through the service remains yours.
9. Privacy
Your use of the service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
10. Warranty disclaimer
The service is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that any SMS will be delivered, will be delivered without delay, or will arrive intact.
11. Limitation of liability
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to liability, or (b) one hundred Singapore dollars (SGD 100). In no event will we be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, or loss of business opportunity.
12. Indemnity
You agree to indemnify and hold harmless One91 Network Pte. Ltd. from any claim, loss, or damage (including reasonable legal fees) arising out of your use of the service in breach of these Terms or applicable law, including any complaint from an SMS recipient that you contacted without proper consent.
13. Termination
You may stop using the service at any time by uninstalling the app and revoking your API keys from the portal. We may suspend or terminate your access if you breach these Terms. On termination, your data will be handled in accordance with our Privacy Policy and the account deletion guide.
14. Governing law
These Terms are governed by the laws of the Republic of Singapore. Any dispute arising out of or in connection with these Terms shall be resolved through the courts of Singapore.
15. Changes
We may update these Terms as the service evolves. Material changes will be announced 30 days in advance via the portal. Continued use after the effective date constitutes acceptance.
